Rule #1, don't talk about this anywhere else.  I saw one person mention it, I don't remember if I said last time to not talk about it, but I'm saying it now.  Don't talk about this.  I don't want Jagex to know I've even acknowledged their emails (or in this case, actual letter).

Ok, this time they had a law firm send an email, when I ignored that the law firm sent a registered letter all the way from the UK.  Unfortunately I was out today for about an hour or so, just long enough for the mail to come and my wife signed for it (doh!).  I still don't think they have a case, but I'm going to take some precautions (you may notice the new disclaimers on all RuneScape related forums).

Don't worry, the RuneScape forums aren't going anywhere yet.  My guess is the worst case would be that we rename them to something not related to RuneScape, and maybe even have some "rules" that prohibit users from talking about certain things (such as hacking/cracking RuneScape, though everything I've seen has been bogus, and buying and selling).  Of course, it'll be hard for us to moderate every single thread (especially if we suddenly lose our moderators, wink wink), and we'd have to rely on Jagex to report every single infringing post.  In this scenario, not much will change.  I mean, instead of saying you're selling a RuneScape character, you just say you're selling a character on a well known game, give the stats, and say to PM for more info.  Everyone knows you're selling a RuneScape character, but if you don't actually say it, Jagex can't prove that's what you're talking about.  I doubt they'll go to the trouble to have someone sign up on the forum and PM everyone asking what game is their character on, even if they did, I personally am off the hook (just by looking at the post, which doesn't mention RuneScape, I have absolutely no idea that they're talking about RuneScape).

Just thought you guys should know, this way you won't be surprised if for example the RuneScape forums become the PuneScape forums or whatever.  If they're renamed, just act surprised like everyone else but tell everyone in hushed tones that it's still business as usual.

Oke dokey, but what if jagex really do do something about it, wont you be fined or anything :S?

Even if we were fined, technically I don't own the site, I just run it.  An incorporated entity owns the site, and would be the one fined.  If the fine is in the hundreds or a few thousand, no biggie.  If it's in the tens of thousands or more...bye bye website and the incorporated entity (but no other loss to me, so since the risk to me is minimal I'm less likely to pull all mention of RuneScape from the forums "just in case").

They havn't got a case though, the game is copyright but the items and accounts arn't, well thats what I heard anyway

well in that case i think because of the newbs posting the crap they do mabye the elites get to lock threads for a little while under the condition that we use it properly otherwise loose your place as anti scammer.

But thats just a sujestion.

Also i think Jagex is parinoind. They have gotten quite lazy these days, my friend got a week ban and lost his modship for saying" if i report you you have a bigger chance of being banned" now thats bad.

Yea I agree some more precaution should be taken but I personally don't see this as anything serious... If anything just say that you are selling the password to the account, that way you aren't claiming ownership of the character (because they could try and say that they own everything in the game and that people are selling what they own) instead you are claiming ownership of the password and I don't think they can clain they have legal ownership of your password...

I always thought Jagex's threats were just to scare site owners into taking down the site, but most of the Runescape forums with cheats and underground sections that I've been a part of that got threats from jagex have all eventually vanished.   I hope this isn't the future for TechGuide.

There's two main differences between this site and the others.

One, most site owners would freak and close up shop, especially once an actual letter was received.

Two, most webhosters, upon receiving an email mentioning the words copyright infringement, would immediately pull the plug on the site.

Now, myself being stubborn and all, and being my own webhost, am not going out without a fight.  I'm going to call their bluff and see what happens next.

I don't know guys mabye jagex has something there not telling us so we don't take precautions. We should be carefull.
We aren't 100% sure they don't have a case. If the do have something they aren't telling us mabye they won't because then they can get there money because we acted like they got nothing and mabye thats just what they want us to do.

For one, I haven't heard of anyone being taken to court due to having a forum/website related to a company or their product.  The only thing I've heard about is people getting into trouble due to slander, if that's the case then the person posting that would be the one to get into trouble.  In case you don't know what slander is, it's just bad-talking someone.  So if you say Jagex is sh*t, or make up an elaborate lie saying Jagex comes and kidnaps scammers in the middle of the night and has a secret prison...that could be slander (even if it's true, it might be slander...at the very least they can give you a bit of a legal headache).

That's not the case here, generally people aren't bad-mouthing Jagex, and if they were Jagex would be either asking me to take those specific posts down, or asking for the information of the users posting that (which, barring a court order, I don't have to give out).  Well, barring a court order or a letter from the FBI (which I have received once before and complied with, but it had nothing to do with this site, rather it had to do with a customer of mine who apparently had some stuff on his server he shouldn't have).

So, basically they don't have a case, if they pursue it, it'd be a frivilous thing, and even then they'll have to go to the trouble of hiring a lawyer in the US to handle this for them.  They can't file a suit against me in the UK.  I'm in the US, the server's in the US, they have to bring it here.
