Can Someone Help Me Out

Recently someone posted on my site as 'Mod paul' Saying that they are jagex and if i don't shut down my site they will take legal action, I just wanted to know if you think this is jagex or not, they talk formal but they say they will email me, and jagex don't email people.

 There name was mod paul, and this is what they posted:

  This and many other RuneScape cheating based websites have been reported to JagEx by a user. The one who has ownership and Administrator privlages will be contacted via e-mail shortly. We will the politley ask him to remove his website and give us all the IP adress's that have visited here. (So we may IP ban all of the users of this forum) If he does not give us the IP adress's and shut down the forum, or does not respond withen twenty-four hours, LEGAL ACTION WILL BE TAKEN! Thank you for your time. You will probablly ignore all this, delete this message, and ban me.

u say he's got good grammer, and talks formally? nahhh, not eeeeven, look, i already spotted a few dumb errors this bloke made, "politley" (politely), and "withen" (within)...andd "probablly" (probably).  hmm, now secondly, "You will probablly ignore all this, delete this message, and ban me", jagex wudnt say this.

truss me u got nothing to worry abt, and i can safely say this cause ive personally read a legit jagex message regarding rs black-markets

im looking for the article now, they have no legal right to sue, they use it as a scare tactic, they have every right to ban us, but none to fine us

They could sue any website about runescape for breaking tos and copyright.


This forum could be sued like in the passed we got threatened..


But yeah, mainly they do it to scare us it costs to much for them to take us to court.

Software

In general, copyright law treats software as a type of literary work and grants copyright in the code that makes up a piece of software. This principle is established under international law by article 10 of the TRIPS[1]Agreement (Trade Related Aspects of Intellectual Property Rights), which reads (art. 10(1) TRIPS):  ‘Computer programs, whether in source or object code, shall be protected as literary works under the Berne Convention (1971)’. Though by tradition, WTO member states have interpreted international treaties in subtly different way when enacting or revising national laws.

US law follows the general thrust of international and most national laws stating (17 USC §101[2]): ‘A “computer program” is a set of statements or instructions to be used directly or indirectly in a computer in order to bring about a certain result’. Since Apple v Franklin[3] the US courts have affirmed the position that copyright covers instructions at three levels of code: high level languages, binary and object code. The judgement also re-enforced that “it is only the instructions themselves” that are covered. This scope excludes two areas: the idea for a program as opposed to an individual express expression as recorded in code; and data upon which instructions operate (see below for further scope limiting cases).

The European position is slightly more ambiguous, at least at the level of statue. The so called European ‘Software Directive’[4] states “the term ‘computer program’ shall include programs in any form”, and the UK’s implementation of this directive into English law provides no explicit definition of software whatsoever. Instead the Copyright, Designs and Patents Act[5] defines a ‘literary work’ variously as (Act sec. 3(1)): A table or compilation other than a database, a computer program, Preparatory design material for a compute program, a database.

English law thus relies heavily on case law rather than legislation to define the scope of software, and case law (at least in respect of software) rests heavily on the interpretive procedures and definitions created in US courts (Lemley .

a side note, if you are 18 and under you cannot enter a legal agreement, therefore you are not bound by the terms and conditions, in a court of law

Er.. I don't understand the article, but what do you mean about the 18 and under bit,??

means, if you are 18 and older, when you sign up for your account you aggreed to there terms and conditions, well if your over 18 then they do have some legal grounds, but if you are under 18, you cant be bound to it. even if you are 18, they would still have a hard time prosecuting you

If you put an Entry page up, and makes them agree that they are not Jagex or affiliated in anyway with Jagex, then there is nothing that they can do.

Because if they violate the TOS then there can be no legal action taken against you or your site
